Appeal Court Upheld PDP Candidates Senatorial Election in Plateau State

An Appeal Court sitting in Abuja has overruled a petition challenging the election of Gyang Pwajok of the Peoples Democratic Party (PDP) as the Senator to represent Plateau North Senatorial District.

CEOAFRICA.com gathered that Justice Oyebisi Omoleye delivered the judgement and dismisses the case filed by the defunct Congress for Progressive Change (CPC) on the basis that the party is no longer a recognized entity.

According to the court, “It is in now in the public domain that the CPC that is a respondent in this case has been subsumed by a larger party, All Progressive Change (APC).

“In view of that, the issues raised by the party in the suit that changed the victory of the appellant have become academic, hypothetic back by no facts.

“As you can see clearly from the process before this court, no respondents listed in the appeal file any responses to issues of law raised by the appellant,’’ she said.

This judgement then nullified the December 20, 2012 declaration by the Federal High Court Abuja that the bye-election which brought in Pwajok.

“The Dec. 20 judgment of the Federal High Court Abuja nullifying the election of the appellant is hereby set aside.

“In the circumstance, all the declarative and injunctive orders made by the lower court asking the appellant not to parade himself as Senator representing Plateau North Senatorial District have become null and void.

“The Independent National Electoral Commission (INEC) is ordered not to contemplate a fresh election in Plateau North Senatorial District until the end of Gyang tenure as a Senator,’’ the justice said.
