Sugar's ambush; Court vouchsafes "chief suspect's" bail

Sequel to the 2019 9th of March ambush of Late Honourable Temitope Sugar; a member of the House of Representatives from Lagelu/Akinyele constituency, Olafisoye Akinmoyede, a serving member of the state House of Assembly from Akinyele was arrested, together with four other suspects, and were all "under protective custody" after apprehension to Abuja.

This "Chief Suspect's" bail was vouchsafed at Oyo State High Court sitting held on Thursday in Ibadan.

Michael Lana, his counsel approached Justice Moshood Abass and entreated to enforce the fundamental human rights of the house whip over a stretch out of confinement.

He had beseeched for a pronouncement of unlawful acts villainous to fundamental human rights from the court towards the subsisting confinement of his client in the police custody in Abuja.

The steering judge, Justice Abass, addressed the absence of the respondent's counsel, the commissioner of police as arrogant, unlawful and unconstitutional.

He affirmed that it is illegitimate for police to arrest before investigating.

The Judge added that “The power of the police to arrest and detain is not in doubt but the constitution stipulates that any person detained must be arraigned within 24hours.

“The remand order obtained by the police from an Iyaganku Magistrate court had expired since April 4 and detaining the applicant beyond this period is flagrant disobedient to the constitution.

“Obedient to court order should be the responsibility of all who believe in the stability of Nigeria”

In this vein, the judge conjoined that the police had not dispensed vindication which could aid the court from not vouchsafing bail to the petitioner.

The judge thereby held that the petitioner's bail should be vouchsafed with a guarantor of grade level 14 in civil service or member of the House of Assembly/Federal alongside a blood relation who has a land of N50 million worth.
