Court Hears Impeached Governor Nyako’s Reinstatement Suit Today

Arguments had earlier been canvassed in the matter and judgment fixed before the former acting Governor in the state, Umaru Fintiri filed an application to nullify proceedings in the suit so far.

That application stalled the judgment as Justice Abang adjourned to hear that application.

The applicant (Ogungbeje), who was irked by Justice Abang’s decision, had earlier petitioned the Chief Judge of the Federal High Court, Justice Ibrahim Auta, asking that the matter be re-assigned to another judge.

But despite the petition, Justice Abang was said to have been directed to continue with the case since it was at judgment stage.

Ogungbeje had in the petition to the CJ said he had lost confidence in the ability of Justice Abang to dispense justice in the matter.

The lawyer was particularly furious with the judge for adjourning the matter till after the by-election in Adamawa State, a development which he claimed would only make the suit in court an academic exercise if allowed to stand, as election must have been conducted on October 11.

But eventually, the election did not hold, as another Federal High Court, Abuja ordered Fintiri to vacate office and ruled that Nyako’s deputy, Bala Ngilari be sworn-in, an order which had since been carried out.

In the suit in Lagos, Ogungbeje had argued that Nyako’s impeachment was a clear departure from the due process of law, and prayed the court for an order reinstating him as governor.

Specifically, Ogungbeje is seeking a declaration that the setting up of a seven-member panel by Chief Judge of the state after an order stopping the Adamawa State House of Assembly from constituting the panel was biased.
