NURTW: Court declines jurisdiction over Akinsola's contempt against Ajimobi, others

A Federal High Court judge sitting in Ibadan, Oyo State on Thursday declined

jurisdiction over the application of enforcement of fundamental human rights filed by the embattled chairman of National Union of Road Transport Workers (NURTW),Alhaji Lateef Akinsola a.k.a Tokyo and 14 others against the Governor Abiola Ajimobi,the Commissioner of Police and 16 others.

 

Justice Abimbola Adejumo Obaseki, while delivering ruling on the application declared that it would tantamount to judicial rascality for the court to assume jurisdiction over the case once a copy of the notice of appeal against the judgement of the court delivered by Justice Jonathan Sarkaho on 25th of May 2012.

   

He ruled that although the applicants have the right to seek for enforcement of their rights especially once a competent court of law confirmed such a rights ,but once the defendants had appealed against the judgement and a notice of such an appeal served on the lower the trial judge must stay action pending the pronouncement of court of appeal. Akinsola in his motion on notice filed by Barrister Olalekan Ojo,  prayed the court to commit the Oyo State governor, the Commissioner and the Attorney- General of the state to prison for their various acts of contempt of the honourable court setting up or aiding or abetting the setting up or constitution of the 14- man caretaker committee to running the affairs of NURTW.

 

He also prayed the court to commit the 4th to the 16 respondents to prison for their contempt on the honourable court by their agreement to be sworn in as members of and serving as members of the 14-man caretaker committee set up by the Oyo State government in collaboration with the 3th respondent (The National President of the NURTW for the running or management of the affairs of Oyo State chapter of the NURTW in violation of order contained in the judgement of the court delivered on the 25th May 2012 among other.

 

Akinsola had in the suit number FHC/IB/CS/30/2012 and the application filed

Committal proceeding against the Oyo state governor, Senator Abiola Ajimobi and other respondents over the alleged disobedience of the order contained in the judgement of the honourable court delivered on May 25th, 2012.
