Lawyers call for review of outdated laws

Some Lagos-based lawyers today called for review of laws which provisions no longer reflect realities to advance justice administration and preserve Nigeria’s integrity.

 The lawyers explained that the provisions of some laws had been overtaken by societal development.

Mr Ogedi Ogu, also a rights campaigner, said that the country’s legal system had come a long way and required regular review.

Ogu said: “For instance, certain provisions of the Companies and Allied Matters Act (CAMA) which largely regulates commercial activities in the country have been in existence since 1970.

“CAMA sets out guidelines for those who will incorporate a company, but today, we find that even accountants now incorporate companies and this appears acceptable by the Corporate Affairs Commission.

`In terms of monetary penalties, the Act stipulates some fines which in recent times are viewed as ridiculous. “From all indications, the law is calling for a review.’’

 According to Ogu, there is the need for constant review of such laws to promote best practices.

Ogu called on judicial officers and workers to show more commitment to promoting justice, noting that the functions of the judiciary were critical to national development.

He urged quick dispensation of justice. Mr Anthony Makolo, also a Lagos-based lawyer, and also called for a review of laws which provisions were no longer realistic.

He, however, expressed satisfaction at the provisions of the Administration of Criminal Justice Act, 2015, which he said, redefined crucial aspects of the country’s criminal jurisprudence.

 Makolo appealed to judicial officers to be astute especially in the adjudication of corruption cases which he said, formed the bedrock of judicial cleansing.

 “It is important for judicial officers to effectively advance the concept of an incorruptible justice system by turning away from frivolous applications and injunctions aimed at stalling justice and portraying judiciary in bad light,’’ he said.

 He urged the officers to shun fear, favour or bias but stick to the provisions of the law.

 Makolo said that Nigeria’s success in its fight against corruption would preserve its integrity.

Constitutional lawyer, Mr Spurgeon Ataene, advocated organization of regular forums for lawyers and judicial officers to create a good atmosphere for justice administration.

He also called on lawyers to play their roles well in justice delivery to move Nigeria’s legal system forward.
