INEC restores David Mark-led ADC leadership following Supreme Court ruling

The Independent National Electoral Commission (INEC) has reinstated Senator David Mark as National Chairman of the African Democratic Congress (ADC), along with other members of the party’s National Working Committee, after updating its official records.

A review of INEC’s website on Thursday night confirmed the restoration of the ADC leadership structure, with former Osun State governor Rauf Aregbesola listed as National Secretary. Also reinstated are Dr. Mani Ahmad as National Treasurer, Akibu Dalhatu as National Financial Secretary, and Prof. Oserheimen Osunbor as National Legal Adviser.

The commission had earlier removed the names of the officials from its portal in April, in compliance with a directive from the Court of Appeal amid an ongoing leadership dispute within the party. The decision prompted protests from the Mark-led faction and drew reactions from opposition figures.

The controversy stems from a protracted legal battle over the recognition of the ADC’s national leadership.

However, the Supreme Court of Nigeria on Thursday nullified the appellate court’s directive, ruling that the order to maintain the status quo ante bellum could not subsist after the determination of the relevant proceedings. The apex court described the continued enforcement of the directive as unnecessary and legally unsustainable.

The court also upheld the appeal filed by the Mark-led faction and directed that the substantive suit instituted by aggrieved party chieftain Nafiu Bala Gombe at the Federal High Court be heard expeditiously on its merits.

The reinstatement has been welcomed by the Mark-led faction as a significant affirmation of due process and internal party stability. Nonetheless, the broader legal contest over the legitimacy of the ADC leadership remains unresolved, with the substantive case still pending before the Federal High Court.
