
Justice Olamide Folahanmi Oloyede was on Tuesday absent at the probe panel investigating the matter of her petition to the Osun State House of Assembly against Osun State Governor, Mr Rauf Aregbesola over the state workers unpaid salaries and allowances.
Justice Oloyede who was absent at the probe panel to defend her petition against the governor was represented by a lawyer, Mr. Lanre Ogunlesi, Senior Advocate of Nigeria (SAN).
Oloyede's lawyer however requested for the response of the Ogbeni Rauf Aregbesola to the petition before she could appear at the Assembly (panel). The lawyer said the judge would not appear before the panel in person unless the response of the governor was given to her.
While responding to the matter, Chairman of the panel, Hon. Akintunde Adegboye frowned that Justice Oloyede had broken three rules of the parliament in line with order 126 (1 to 6) of the parliament.
Adegboye drew the attention of the Oloyede's lawyer to the popular parlance, "he who alleges must prove". He added that Oloyede's petition at the fourth paragraph was categorical on her readiness to appear with her evidences to back up her petition and insisted that the committee would not give her what was not requested for ab-initio.
Speaking with journalists shortly after the committee sitting, Ogunlesi explained that justice and fair hearing demand that the petitioner be availed with the governor’s response to her petition.
“Fear hearing demands that as a first step to defending the petition, it is necessary for the petitioner to be provided with the governor’s response. What we discussed with them was that for us not to waste time on this matter, answers to the petition by the governor should be made available.
“The panel said the committee was a fact-finding one, but the issue at stake was a serious one and for the sake of posterity and the people yet unborn, they need to forward the answers to her. Once that is done, I assure you that she will be here. We are not running away. She is bold enough to write the petition and she is prepared to defend it. If she should have the reply today, she will be here tomorrow”, Oloyede’s lawyer said.
