11.5bn Fraud against ex-Oyo Gov, Senator, court adjourns

An Oyo State High Court on Wednesday adjourned hearing on the alleged N11.5billion fraud case involving ex-Oyo State governor, Adebayo Alao-Akala, Senator Hosea Agboola and Olufemi Babalola pending the outcome from the Court of Appeal. An application to quash the earlier judgment delivered by Justice Akintunde Boade had been submitted before the Court of Appeal.

 

The Economic and Financial Crimes Commission (EFCC) had accused the trio of

conspiracy, illegal award of contracts, obtaining money by false pretence and

acquiring property with money derived from illegal act as well as concealing the ownership of such property.

 

At the sitting Justice Bayo Taiwo adjourned the case when Mr Lateef Fagbemi (SAN) counsel to Alao- Akala and Olufemi Babalola told the court that no decision had been taken by the Appeal court on the matter. Fagbemi urged the court to wait for the final determination of the suit at the Court of Appeal before proceeding on other matter.

 

Agboola’s counsel, Mr Richard Ogunwole (SAN) pleaded with the court on the absence of his client and allied himself with the submission of Fagbemi.

It would be recalled that the counsels had told the court that they were not

satisfied with the content of the charge against their client and this informed the application to quash the judgment.

 

Boade had on December 12, 2012 ruled that Alao-Akala, Agboola, a former commissioner in his administration and Babalola, a businessman, had a case to answer in the suit instituted by the (EFCC).

The re-assignment of the case to Justice Taiwo was necessitated by the retirement of Boade on February 21. Taiwo had granted a temporary bail to Alao-Akala, Agboola and Babalola.
