Murder: Court grants bail to drunk driver

The drunk driver who  crushed and killed Mr Timothy Adeosun, a sales representative of the Nations Newspaper, on New Year day, was yesterday granted bail by a Magistrate Court sitting in Ibadan.

The accused person, Mr Kunle Adepoju, the driver had crushed Adeosun, alongside his colleague with ThisDay newspaper representative, Mr Juwon Babalola, along Salvation Army Road of Ibadan.

Babalola narrowly escape death but serious injuries. In the case number MY/3C/2014 presided over by Magistrate Safiyat Oyediran of Court 2, Adepoju was arraigned on a seven count charge by the Investigating Police Officer (IPO), ASP Asimiyu Oyelowo.

According to the charge sheet made available to pressmen, the accused stood trial for reckless driving, murder, damage of private property among others, which were punishable under the laws of Oyo State.

"That you Kunle Adepoju 'M' on the 1st day of January, 2014 at about 03:00am at Salvation Army Oke-Paadi Ibadan Magisterial District being the driver in charge of Accura saloon car with registration number FKJ 894 BB did drive same on the public highway in a dangerous and reckless manner which is dangerous to the public , having regard to all the circumstances of the case, including the nature, condition and use of the highway, and the amount of traffic which actually at the time, or which might reasonably be expected to be, on the highway, caused the death of one Timothy Adeosun 'M' aged 27 years and thereby committed an offence contrary to and punishable under section 27 of Road Traffic Act. Cap 548 part VII, laws of Oyo State of Nigerian" part of the charge read. But to the surprise of all present at the court yesterday, Adepoju pleaded not guilty to all the charges levelled against him.

However, Magistrate Oyediran granted him bail with #250,000 and with two sureties in like sum and one of them must be a level six civil servant, while the other must be a blood relation. The case therefore adjourned till the 5th of February, this year.
