A 73 year old man arraigned for alleged fraud

A 73-year-old man, Mubasiru Abiola, on Monday appeared before an Abeokuta Magistrates’ Court for alleged fraud for selling one acre of land to two persons.

The accused is facing a two-count charge of fraud and stealing.

The Prosecutor, Insp. Augustine Ozimini, told the court that the accused committed the offence on May 17, 2013 at Obada-Oko, a suburb of Abeokuta.

He said that the accused defrauded one Pastor John Joseph under the pretence of selling one acre of land valued at N1.5 million to him.

Ozimini said that the accused sold the land to the pastor knowing that he had already sold the same land to someone else.

“The pastor was accosted on the land by the other person who had earlier paid for the said land.

“When the pastor confronted the accused and demanded for a refund, Abiola refused to refund the said N1.5 million,’’ the prosecution said.

The prosecutor submitted that the offences contravened Sections 419 and 390 (9) of the Criminal Laws of Ogun, 2006.

The accused pleaded not guilty.

The Magistrate, Mr Emmanuel Adekunte, admitted the accused into bail of N100, 000 with two sureties in like sum.

He then adjourned the case to Jan. 20, 2015 for further hearing.
